Please read these companyxiv.com, Théâtre XIV, Cocktail Magique Theatre, AMDM Productions LLC, Cocktail Magique LLC and Company XIV Dance Inc. (collectively, the “Service Providers”) Terms and Conditions (“Terms and Conditions”) before using this site. By continuing to access or use this site, or any service on this site, you signify YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

Welcome to companyxiv.com (the “Site”). By using or registering for the services offered on the Site, at a venue or otherwise provided by the Service Providers (collectively, the “Service”), users and the entities or persons they represent (“User”, “Users”, “Customer” or “Customers”) agree to be legally bound and abide by the terms, conditions, and notices set forth or referenced herein (the “Terms and Conditions”). Your continued use of the Site and the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes. If you do not agree to these Terms and Conditions, please do not use the Site and the Service. Any terms and conditions proposed by you that are in addition to or conflict with these Terms and Conditions are expressly rejected by the Service Providers and shall have no force or effect. You represent that you have read and agree to be bound by these Terms and Conditions, as well as our Privacy Policy located at https://www.company.com/privacy-policy/ (“Privacy Policy”) which is incorporated herein by reference and which you should review.

VENUE RULES

These rules apply to Théâtre XIV and Cocktail Magique Theater (“Venue” or “Venues”). Venue rules are subject to change. Customers who do not abide by the rules will be denied entry or ejected without refund.

Ages 21+ Only

State-issued photo identification required for entry.

Health & Safety

We are closely monitoring local and federal recommendations regarding the COVID-19 pandemic. We are no longer requiring proof of COVID-19 vaccination and mask wearing is optional. Additional health and safety protocols may apply at the time of your performance.

Right to Refuse Service

Service Providers reserve the right to refuse service for any reason, with or without refund. Intoxicated customers will not be served.

No Outside Food or Beverages Allowed

Customers may not bring any food or beverages inside the venue. Customers who bring in outside food or beverage will be ejected without refund.

No Professional Photography Permitted

Professional photography is not permitted inside the venue. Please don’t bring professional photography equipment to the Venue. Customers with professional photography equipment may be asked to check it at the door. Customers may only use their phone to capture images for the purpose of sharing on social media. Flash is not permitted. Customers who engage in flash photography or professional photography will be ejected without refund.

Respect Employees & Other Patrons

Touching Service Provider employees is strictly forbidden. Customers who touch an employee will be ejected without refund. Customers may not disturb other Customers. Talking must be minimal and at an appropriate volume, especially while the performance is in progress. Customers who engage in loud and/or excessive talking will be ejected without refund.

Attendee Image Release

You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to the Service Providers, their partners, licensees and assigns, including but not limited to our brand and media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.

Recording, Transmission & Exhibition

Recording of performances at the venue is limited to amateur devices like cell phones for purposes of sharing on social media. You may not use professional photo or video equipment to photograph, document or record anything inside the venue or publish any photography or video captured inside the venue anywhere except on social media.

In the case of online streaming and/or virtual events (“Streaming Events”), you may view the Streaming Events solely for your own personal purpose. You may not record, copy, publicly exhibit, transmit, or distribute any Streaming Event through any means, resell views of any Streaming Event, or allow others to log into your account for the purpose of watching a Streaming Event.

TICKET SALES

Pricing

The Service Provider’s pricing for tickets and services are outlined in detail on every transaction. The final total purchase price includes the established price of the tickets, upgrade fees, applicable taxes, gratuities if applicable and a service and handling fee (“Service Fee”). In addition, for an additional fee, clients may have the option of choosing to add Cancellation Protection for select shows and performances (see below).

Upgrades & Preorders

A selection of Food, Beverage and/or Merchandise may be ordered to be delivered upon arrival and consumed at the venue on the event date (“Preorders”) for additional fees (“Preorder Fess”). By selecting Preorder you attest you understand the Preorder is not itself part of a ticket. Under New York State Law tickets are not subject to tax or gratuity. Preorders, however, are subject to tax and gratuity. User attests they understand the Preorder Fess are not a part of the ticket price. These fees are itemized separately on the transaction summary displayed to patrons prior to collecting payment for each order and again on each receipt.

Purchasing a Preorder does not guarantee delivery of the goods purchased as upgrade availability is subject to change. Service Providers reserves the right to refuse service to any patron for any reason. Service Providers are prohibited by law from serving intoxicated patrons. In the event Service Providers are not able or otherwise choose not to fulfill a Preorder, a full refund of the Preorder Fee will issued to the original payment method.

Glitter Up

Glitter Up is an online auction that gives ticketed patrons the chance to place a bid to upgrade their reservation into one of our premium seating options: Champagne Couches or other designated VIP Seats. Service Providers may send an invitation to a ticket holder in their sole and absolute discretion based upon the original booking, seating availability and other factors determined by Service Providers. Service Providers may accept or reject any bid in their sole and absolute discretion and regardless of availability. All Glitter Up bids will be approved or rejected sometime after the bid is placed and before doors open for the ticketed event (typically one hour prior to the event start time). If your Glitter Up bid is approved, you’ll be notified and receive a new ticket via email. At this time, the credit card used to pay for your original ticket will be charged. If your bid is approved you will be charged the full amount of your bid and billed separately from the price you have already paid for your ticket.

Service Fee

A Service Fee is added to all tickets purchased on companyxiv.com or over the phone.

Ticket Delivery

All tickets are delivered electronically to the email address you provide at the time of your reservation.

Ticket Transfers

You must email reservations@companyxiv.com to transfer your tickets to another person.

Event Cancellations

If an event is canceled, postponed, rescheduled, or moved, we will attempt to contact all ticket holders to update them on the status of the event, and inform them of any refund, credit, or exchange procedures. For exact instructions on any particular canceled, postponed, rescheduled, or moved event, please check the event information online, which will include the most current information on the status of the event, or contact us at reservations@companyxiv.com.

Service Providers will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event.

PURCHASES

Purchase Policy

We accept all major credit and debit cards. All charges for events at Théâtre XIV will appear as “THEATRE XIV” on your bank statement, while all charges for events at Cocktail Magique Theatre will appear as “COCKTAIL MAGIQUE”. Please note, all Gift Shoppe, Streaming, Delivery and Ticket purchases are final sale.

Refunds

Please note, there are no refunds. All sales are final.

At our option, we may offer cancellation protection at an additional cost above the cost of your ticket. If Cancellation Protection is available the additional fee will be displayed and presented as an optional add-on at the time of your ticket purchase. With this protection, tickets may be cancelled up until forty-eight (48) hours prior to the actual performance date. You must notify Service Providers of your intent to cancel by email at reservations@companyxiv.com no later than forty-eight (48) prior to the performance. You must include the order confirmation number, your daytime phone number. If you purchased Cancellation Protection and comply with the above conditions, you will be issued a refund for the amount of the face value of the tickets, but not for the cost of the Cancellation Protection, Service Fee, and any applicable handling/delivery fees. On orders without Cancellation Protection, there are no refunds or exchanges.

Shipping & Delivery Policy

For purchases which require shipping, patrons can select from a variety of shipping options. All orders are shipped within 2 business days of purchase. Delivery times are estimated. We are not responsible for shipping delays.

MESSAGING

General

When you opt-in to the service, we will send you a message to confirm your signup.
By opting into messages, you agree to receive recurring automated marketing and informational text messages from Company XIV for Company XIV. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.
Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Company XIV. Company XIV reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Company XIV also reserves the right to change the short code or phone number where messages are sent.
Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.
Your consent to receive marketing messages is not a condition of purchase.

Carriers

Carriers are not liable for delayed or undelivered messages.

Cancellation

You can cancel any time by texting “STOP”. After you send the SMS message “STOP”, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Company XIV again, just sign up as you did the first time and Company XIV will start sending messages to you again.

Transfer of Number

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at reservations@companyxiv.com. The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes

We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes

PUBLIC HEALTH PROTOCOLS

COVID-19 related health protocols may be in effect at the time of performance, including, without limitation, required: vaccine requirements, mask or face coverings, temperature checks, testing, confirmation of prior travel to restricted areas and/or confirmation of no known symptoms of and exposure to COVID-19. The venue or event providers may unilaterally make changes to health protocols according to updated public health guidance and applicable law. Any ticket holder who does not comply with any COVID-19 related health protocol may be required to leave the venue without refund. Guests with accessibility questions, or who require additional assistance related to the venue’s COVID-19 policies may email reservations@companyxiv.com.

An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against the Service Providers and their respective parents, affiliates, subsidiaries, sponsors, successors and assigns and their respective officers, employees, contractors and agents.

INDEMNIFICATION

You agree to indemnify, defend and hold the Service Providers, their owners and affiliates and their respective officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers (collectively, the “XIV Parties”), harmless from all claims, demands, liabilities, losses and damages (actual and/or consequential) of every kind and nature, known and unknown, and expenses (including reasonable attorneys’ fees and disbursements), arising out of (i) your use of the Service, (ii) a breach of your representations and warranties or obligations set forth in these Terms and Conditions or in the Privacy Policy, (iii) your violation of any law or the rights of a third-party; or (iv) the infringement or misuse by any other user of your account or any information, data, text, software, music, sound, photographs, graphics, video, messages, or other intellectual property of yours on the companyxiv.com website. The Service Providers reserve the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the Service Providers in asserting any available defenses.
